from Judge Rakoff's decision:

“An application of judicial power that does not rest on facts is worse than mindless, it is inherently dangerous. The injunctive power of the judiciary is not a free roving remedy to be invoked at the whim of a regulatory agency, even with the consent of the regulated. If its deployment does not rest on facts — cold, hard, solid facts, established either by admissions or by trials -it serves no lawful or moral purpose and is simply an engine of oppression.

“Finally, in any case like this that touches on the transparency of financial markets whose gyrations have so depressed our economy and debilitated our lives, there is an overriding public interest in knowing the truth. In much of the world, propaganda reigns, and truth is confined to secretive, fearful whispers. Even in our nation, apologists for suppressing or obscuring the truth may always be found. But the S.E.C., of all agencies, has a duty, inherent in its statutory mission, to see that the truth emerges; and if it fails to do so, this Court must not, in the name of deference or convenience, grant judicial enforcement to the agency’s contrivances.”

also, given the Day's 'accion', I flipped on CNBS' "Fast Money"..

they pulled out a dude 'looking for U$D ~1100/Au'...

~Everybody, for the most part, was on the "'MMods are Dead"-bandwagon...

riight, like Rice & Sugar are sub-10, Corn & Wheat are in the 3s, 'beans in the 5s .....

pretty soon, after Au & Ag go to 0-bid, we'll be finding bars, piled up with the 'Newspapers'--u know, 4 're-cycling'..

toward the end, ~10:00-mark is an interesting concept, interposed by Faber, 'shortening Chains of Collateral' ....

Me: "Dude. No idea. We're in a triangle still. Just run a stop just below whatever level would cause you to be really pissed at yourself for not covering sooner."

how's that for some "sound" advice...bwahahahaha

Not called GOLD anymore... It's called 'UNOBTANIUM' (Unless you're willing to renegotiate the "over spot" markup...

U can still get nickles though (if you're willing to endure the stupid look from the pimply faced teller)...

Since the dollar is going to a "brazillion" (and will probably BUY you the country of Brazil pretty soon... just in time for... drumroll... 'THE OLYMPICS')...

Well... Your exquisite pleasure in owning nickles is that you're not TAXED on the transaction...

Plus... You've just removed potentially rehypothecated LEVERAGE from the system...

A bank can't make any money off your stash of nickles... (Which means to say that a box of Cheerios would have a hard time going from 2 bucks to 7 bucks if everyone owned a stash of nickles...

But instead...

- everyone wants to drive a Porsche or Beemer (which just put the cost of the loan into the system + plus the leverage, & derivatives...

- now go down the list of everything that is bought this way, plus all the funds held on account, in pension funds, & other entitlements...

Kind of easy to see why Cheerios cost so much...

The can't do that against nickles... CAUSE THEY'RE NOT FRN's...

Nifty huh?

What does 'Gresham's Law basically say?... "Bad money chases out good"...

Well I found that out to be EXACTLY the case today...

My BAD money (that I walked into the store with), basically CHASED THAT GOOD MONEY RIGHT AWAY...

It glued it right to the shelves... & my hypothesis is that the more the paper price drops on these, the more UNOBTANIUM they will become...

Of course though, there will always be the Pokemon Card & Beanie Baby markets to trade, you know, for 'enthusiasts' of that sort of thing...

In other words BOOM!!!

I've said this before... I guarantee you that before your life is thru... Even if you make the personal investment to go "off grid" &, say, install solar & wind power for your personal abode... You'll be TAXED on the 'free energy' you collect 9as if you were PAYING for it from the electric company...

Pelosi has already seen to that (in the stuff she didn't read)...

No doubt some in Congress got a boner when they heard that... Probably chartered a jet complete with hookers & blow during the flight (on the taxpayer dole), just to go down there & see what it was all about...

Can never learn TOO MUCH from those wacky Bolivians now can we?

---

See? Shit like this cracks me up (& makes me pissed off at the same time)... Then, I attempt to come on a blog like this & tell people WHY... & in the end I get 'flamed' by some asshat ANON calling me a 'drama queen'...

---

So WTF?... I put, say, a 90 gallon trash can out to collect rainH20 to water my fucking tomatoes during the summer (a basic hypothesis)...

Tomatoes (kind of like Michelle Obama's OKRA - that magically grows itself in the White House garden [in July], while she's over in Spain sunning her 800 pound ass with an entourage of friends, and NEVER needs to be watered, and in the end, just jumps itself into little jars wrapped in Tiffany Boxes while shes ordering Lobster in Martha's Vineyeard... Well anyway... Tomatoes basically grow during the same time period by SCHMUCKS who don't have her magic horticultural skills...

Problem is... you need a lot of water to grow them, & rain is kind of hard to come by in July & August in many parts... So hard to come by, that most city municipalities have A LAW against washing your car, or watering your lawn during these times...

Your only luch is when you get the occasional thunderstorm (which pours hundreds of thousands of gallons - more like MILLIONS) all at once (but the effect on crops lasts only a few days before it's parched again...

So you go for a little 'targeted' irrigation... An average house roof can collect 90 gallons of water in a couple of minutes during a TS... You collect it, have enuf water to get you thru to the next TS...

The TS itself is a fucking GULLYWASHER... So, "stormwater management"... BWAHAHAHAHAHAHA!... Just one of these motherfuckers can raise the level of the Potomac by a matter of feet in no time flat (not to mention all the 'flash flood' warnings you hear on the news plus pictures you see of cars getting stranded...

But they're worried about my fucking 90 gallons...

Gee... I suppose the next day they're going to tell me I can't wash my car with it...

Fucking nimrods...

Oh yeah... but CV is the crazy MF on this blog... Just remember that...

AmenRa,

if you take a look at 'Electrostatic Precipatators' (aka 'Scrubbers'), their mandated use (EPA), relative inefficiencies, and those 'inefficiencies' being acceptable to EPA..

one could make the 'Argument' that...Yes, We are paying to breathe (Dirtier than necessary) Air..

So anyway...

Moral to the story...

Forget about growing any tomatoes in your backyard peeps (because some fucking liberal will tell you that your couple of gallons are disrupting the eventual 'watershed' & thus the migrating patterns of blue footed boobies)... The 'research' for that was funded by your tax dollars & paid a 6 figure salary to some PhD and 'saved or created' 1 job...

Instead... Climb into your SUV and burn about 3 gallons of gas to drive over to the supermarket & buy a tomato (which is probably 90% water), at $3 a pound... Make sure you use your VISA to go into debt on the purchase and we'll spend another TRILLION or so to send troops over to the ME to make sure the gasoline for your SUV only costs you $5 bucks a gallon instead of $6...

Somebody hit the fucking RESET button please!

If you want a tomo

didn't think so...

ANY way in your eyes I was wrong to sell, I know - I know, buy nickels, natgas tanks and gold and maybe other PM's and hide them under my tilapia tank right next to the flint stone and map that shows how many paces to the hidden cave at the nearest mountain, then ride out the apocalypse... getting close?

Oh, and about trading powers, think I've posted many losing trades for some time. I'm ahead, not by much as I'd like but someone has to help pay for those etrade baby commercials that I enjoy. Anywho, still like ya... (although you overwhelm me at times.)

See... Cause the REAL SUSTAINABLE GROWTH phase that this planet needs to go through to pay off all the debt, & put us all on a path to fiscal soundness is going to come from a combination of the following:

- Ritholtz shuffling money in and out of trades for bloated pension accounts

- Thor selling pX90 dvds

- Franklin411 teaching everyone that everything is 'Bush's Fault'

- &, of course, JETPACKS
