I'm not sure about the accuracy of megaphone patterns. The examples he showed seemed to make his point. Is the megaphone pattern an example of an EW?

90 Day UST back above levels not seen since July 2011.

WTI gapped higher at the open. Looked back and found a gap higher in 2004 (which was closed six weeks later before continuing higher). There was also a gap lower in 2001 that was closed 27 weeks later.

If this is a breakaway gap on WTI then I'd expect it to test 109.97 which is midpoint between the 0.0% and 38.2% retrace.
